Terms of
service.
Clear terms for a focused engineering relationship. Last updated: September 14, 2026.
1. The service
MergeDesks is an asynchronous senior engineering service. Customers submit scoped work through GitHub issues, and our engineers return production-ready changes as pull requests for customer review and merge.
Delivery targets are estimates, not guarantees. Timing depends on issue clarity, repository access, dependencies, and customer feedback.
2. Intellectual property
100% of the code generated and delivered to a customer through a pull request belongs exclusively to that customer. Subject to payment for the applicable service, MergeDesks assigns all rights, title, and interest in that customer-specific deliverable to the customer.
MergeDesks retains ownership of its pre-existing tools, know-how, templates, and general techniques, but will not use those rights to claim ownership of the customer deliverable.
3. Private repository confidentiality
Source code and repository information provided from a private customer repository will never be shared outside the people who need it to deliver the service, exposed publicly, or used to train public AI models. We use repository access only to perform the requested work and protect it with reasonable security controls.
Customers are responsible for granting only the access needed for the agreed work and for removing access when it is no longer required.
4. Test Drive and subscriptions
The $99 Test Drive covers the first implementation attempt. If the customer technically rejects the first delivered pull request because it does not meet the agreed acceptance criteria, MergeDesks will refund the Test Drive in full. Requests should include the technical reason for rejection and be made within seven days of delivery.
The monthly subscription may be paused or cancelled at any time, with no minimum term or lock-in. Cancellation stops future renewals; amounts already paid are not prorated unless required by applicable law.
5. Customer responsibilities
Customers must provide accurate requirements, lawful repository access, and timely review feedback. Customers remain responsible for reviewing, testing, approving, and deploying pull requests in their environment.
